Submitting an enquiry or requesting an operational clarity call does not create a consulting relationship. Initial conversations are exploratory and intended to determine whether ClarityLink is an appropriate fit for your operational needs.
3. Separate Engagement Agreements
Any actual consulting work, diagnostics, process design, or ongoing operational support is governed by a separately agreed written proposal or engagement agreement that defines scope, deliverables, timelines, and fees. Those terms take precedence over general website information.
4. Fees and Payment Terms
Fees depend on the operational challenge, scope, and level of ongoing support required. After the initial conversation, ClarityLink will recommend an appropriate engagement structure. Specific fee terms, invoicing schedules, and payment conditions are set out in the applicable engagement agreement.
5. Client Responsibilities
Effective operational improvement requires the active participation of the owner and relevant team members. Clients are expected to provide reasonable access to operational information, facilitate staff involvement where required, and support the implementation of agreed improvements.
6. Confidentiality
All proprietary business information shared during enquiries and engagements is handled with strict commercial confidentiality. Detailed confidentiality obligations may be formalised within the engagement agreement.
7. Intellectual Property
All website content, branding, methodologies, and materials created by ClarityLink remain our intellectual property. Client-specific operational documents created during an engagement are governed by the terms of that engagement agreement.
8. Third-Party Tools
Where technology, software, or automation-supported tools are recommended, their use is subject to the respective third-party providers' terms and licensing. ClarityLink is not responsible for the independent functionality or availability of third-party platforms.
9. Limitation of Liability
To the fullest extent permitted by law, ClarityLink's liability arising from website use or general enquiries is limited. Operational outcomes depend on client implementation and prevailing business conditions. Detailed liability terms are addressed within individual engagement agreements.
10. Governing Law
These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes arising shall be subject to the exclusive jurisdiction of the South African courts.
